In these General Terms and Conditions the following definitions apply:
- Activity: any activity or package offered by Noordkade Uitjes, including but not limited to escaperooms, team building activities and children's parties.
- General Terms and Conditions: the present terms and conditions of Noordkade Uitjes.
- Booking: any reservation made online or made by accepting an offer.
- Customer: the natural or legal person who makes a booking with Noordkade Uitjesjes.
- Participant: every person who participates in an Activity or is on the premises of Noordkade Uitjesjes.
- Agreement: the agreement between Noordkade Uitjes and the Customer regarding participation in an Activity.
- Offer: a written offer made by Noordkade Uitjes to the Customer.
- Participant Declaration: a participant declaration to be completed and signed by a Participant, if applicable.
- Win Action: a promotional action organized by Noordkade Uitjes.
- Cancel: the complete abandonment of the Booking without fixing a replacement date.
- Move: changing the date/time of the Booking at the request of the Customer.
See Article 5 for the conditions regarding cancellation and rescheduling.
2.1 These General Terms and Conditions apply to any legal relationship between Noordkade Uitjes and the Customer and/or Participant.
2.2 By entering the premises or participating in an Activity, the Participant agrees to these General Terms and Conditions, even if the Participant has not made a Booking himself.
2.3 Noordkade Uitjes is entitled to change these General Terms and Conditions. The Customer may object in writing within ten working days of notification. If no objection is made, the changes will be deemed to be accepted.
2.4 If any provision of these General Conditions is null and void or destroyed, the remaining provisions will remain in full force and effect.
2.5 The applicability of purchasing or other conditions of the Customer is expressly rejected.
3.1 The Agreement comes into effect as soon as the Customer places a Booking or accepts an Offer, or as soon as participation in an Activity begins.
3.2 After making the booking, your Booking is final. You should always receive a confirmation by e-mail. If you have not received this, please check your junk mail or contact us by telephone.
3.3 Additional agreements or promises will only bind Noordkade Uitjes if they are confirmed in writing.
3.4 The right to participate in an Activity is personal and non-transferable. The Customer is not allowed to use the Agreement for commercial purposes.
3.5 If there is a difference between what is stated in these General Terms and Conditions and what is stated in any participant statement, what is stated in the participant statement will always apply.
4.1 All prices charged by Noordkade Uitjes are inclusive of VAT and apply per Participant, unless otherwise stated.
4.2 For private reservations of Sim Racing, 100% prepayment is always required.
4.3 For all other reservations, both private and business, there are three payment options:
- cash or by debit card payment on location;
- by invoice (in arrears, within the agreed payment period);
- directly online when making the reservation.
4.4 Gift cards and vouchers are valid only for activities of Noordkade Uitjes and not for catering or third party activities. They are not exchangeable for cash and may not be combined with other actions or discounts.
4.5 If payment requires additional administrative actions (e.g. e-invoicing through external systems), Noordkade Uitjes will charge a starting fee of €50 excl. VAT for this.
4.6 If the Customer fails to pay on time, the Customer shall owe statutory interest and extrajudicial collection costs.
4.7 If external parties pass on price changes or surcharges after the Booking, Noordkade Uitjes jes reserves the right to pass these on to the Customer. This will always be agreed in advance with the Customer.
5.1 Cancellations or changes must always be made in writing by e-mail, quoting the reservation number. Cancellation is only valid once Noordkade Uitjes has confirmed receipt in writing. Without confirmation the Booking remains unchanged.
5.2 The following conditions apply to cancellations and changes:
Groups up to 10 persons
Groups from 10 persons
In case of relocation, the cancellation conditions remain valid with respect to the original booking date
Any costs charged by external parties (such as catering or activity partners) will be charged to the Customer on a one-to-one basis. These costs may include room rental, catering, outside activities or hired staff. Our partners include but are not limited to....
Also costs of partners not mentioned above will be charged one on one in case of cancellation.
5.3 If fewer Participants are present on the day of the Activity than have been booked, the cost for the reserved number will still be charged in full.
5.4 If Noordkade Uitjes cancels the Agreement due to force majeure (see Article 12), the Customer's payment obligation will lapse and any payment already made will be refunded or converted into a voucher.
5.5 The legal right of withdrawal is not applicable, as the services relate to leisure activities with a specific date or period (Article 6:230p sub e BW).
6.1 Participation in Activities is at your own risk.
6.2 Participants must have the required physical and psychological condition. Noordkade Uitjes may refuse participation if, in its judgment, there is insufficient fitness or safety.
6.3 The obligation of Noordkade Uitjes jes consists of an obligation of effort; no guarantee of result is given.
6.4 Noordkade Uitjes is not liable for loss, theft or damage of property of Clients or Participants.
6.5 The liability of Noordkade Uitjes is limited to the amount paid out by its liability insurer. If the insurance does not provide coverage, a maximum of €25,000 per event applies. All related events will be considered as one event.
6.6 Noordkade Uitjes is not liable for indirect damage, consequential damage, loss of profit or damage resulting from third party claims.
6.7 The Customer and Participants will indemnify Noordkade Uitjes jes against claims from third parties related to their participation in an Activity or their presence at the location.
6.8 Noordkade Uitjes works with external partners (such as catering and other providers) for certain Activities and catering. Incidents occurring at or by external parties are entirely the responsibility of that partner. Noordkade Uitjes can never be held liable for this; any disputes should be settled directly with the external party concerned.
6.9 Participants must report on time to the Noordkade Uitjes Uitjes location, as mentioned in the booking confirmation.
If Participants arrive late, this may be at the expense of the reserved playtime or activity. In that case Noordkade Uitjes is not obliged to extend the activity or provide (partial) refund.
7.1 Participants must strictly follow instructions from staff.
7.2 It is forbidden to bring dangerous objects or substances, alcohol, drugs or your own food.
7.3 Camera surveillance and luggage control may take place in and around the venue.
7.4 Service dogs are allowed provided valid identification is shown.
7.5 Noordkade Uitjes reserves the right to refuse entry or terminate participation in the event of disorder, misconduct or violation of the rules.
7.6 Escaperoom solutions and game content must be kept secret.
7.7 Damage, Contamination, Theft or Destruction.
Damage, contamination, theft or destruction to or of property of Noordkade Uitjes or to the building and inventory will be charged in full to the perpetrator.
Damage and pollution include: soiling of rooms, furniture or game parts (for example, by urination, feces or other forms of contamination), as well as theft or taking of property such as beverage bottles, decoration materials or materials needed for activities.
If the culprit cannot be directly identified, the damage may be charged to the Booker or responsible supervisor of the group.
8.1 For children's parties, the group may only consist of children up to 15 years old.
8.2 Special rates apply only on weekdays until 5:00 pm.
8.3 Children's parties in the escaperoom are always accompanied by an employee of Noordkade Uitjes.
8.4 If adults participate as an escort, the regular adult rate applies.
9.1 Noordkade Uitjes processes personal data in accordance with the General Data Protection Regulation (AVG).
9.2 Personal data are used for the execution of reservations, invoicing and related communication.
By accepting the terms and conditions the Customer gives prior consent, for the use of personal data for sending newsletters, actions or offers. The Customer can unsubscribe at any time via the unsubscribe link in the message or by contacting Noordkade Uitjes.
9.3 During Activities, video and/or audio recordings may be made for promotional or security purposes.
9.4 Camera images will be kept for a reasonable period of time and may be provided to third parties, including police and justice, in case of incidents.
10.1 Alcoholic beverages will only be served to persons 18 years of age or older.
10.2 Own refreshments are not allowed, with the exception of water or medically prescribed diet food.
10.3 Vouchers and discount offers are not valid on catering/dining.
11.1 Found objects must be handed in to Noordkade Uitjesjes staff.
11.2 Objects of minor value can be donated to charity after some time.
11.3 Objects of value not picked up within one week may be turned over to the municipality.
11.4 Costs for storage or return are the responsibility of the owner.
12.1 Force majeure means any circumstance which prevents the performance of the Agreement and which cannot reasonably be attributed to Noordkade Uitjes jes.
12.2 This includes, among others: fire, strikes, government measures, power failures, pandemics, epidemics, extreme weather conditions (such as KNMI code red). Code yellow does not count as force majeure.
12.3 In the event of force majeure, Noordkade Uitjes will initially offer relocation. If the Customer does not accept this, a refund will follow in accordance with the applicable regulation. If the force majeure continues for more than 14 days, Noordkade Uitjes Uitjes may terminate the Agreement.
13.1 These General Conditions are exclusively governed by Dutch law.
13.2 Disputes will be submitted to the competent court in 's-Hertogenbosch.
13.3 These terms and conditions replace all previous versions. On existing Bookings, the version in effect at the time of the Booking remains in force.
13.4 These Terms and Conditions apply exclusively to Noordkade Uitjes / The Space B.V. and not to any partners (such as restaurants or other providers).
